GROUP COURSE BOOKING TERMS AND CONDITIONS

1.1. These Terms and Conditions cover all of City Vocal Coach’s Courses. Before booking a Course, Clients should read these Terms and Conditions carefully. If you find yourself unable to agree to them, then you must not order or use the Courses. If, however, you agree to them unconditionally you may attend the Courses subject always to these Terms and Conditions. By booking Courses or accepting an offer from City Vocal Coach to deliver the Courses, or by accessing any of the Courses, you indicate your acceptance of these Terms and Conditions. These Terms and Conditions are supplementary to City Vocal Coach’s General Terms which shall remain a condition of membership of the Site or accessing any Courses via the Site.

1.2. City Vocal Coach may amend these Terms and Conditions at any time by posting the amended Terms and Conditions on the Site. The version of the Terms and Conditions that applies to Courses shall always be the version in force at the time a Course was ordered or an offer from City Vocal Coach to deliver a Course was accepted.

2. DEFINITIONS

2.1. In these Terms and Conditions the following words shall have the following meanings:

• BOOKING CONFIRMATION: City Vocal Coach’s booking confirmation which sets out the details and timing of the Courses, the Venue, and the Fees.
• CLIENT: The person who orders Courses or accepts an offer from City Vocal Coach to facilitate the delivery of the Courses.
• CITY VOCAL COACH: City Vocal Coach Limited, company number 08936086, whose registered address is 30-31 St James Place, Mangotsfield, Bristol, United Kingdom, BS16 9JB.
• FEE(S): The fee(s) payable by the Client for the relevant Courses.
• GENERAL TERMS: The general terms and conditions to which Membership and use of the Site is subject.
• INTELLECTUAL PROPERTY RIGHTS: All patents, copyright, performers’ rights, trademarks, and trade names subsisting anywhere in the world.
• ONLINE COURSE MATERIALS: Materials made available by City Vocal Coach via the Site.
• SITE: The website located at www.cityvocalcoach.com and associated domain names.
• TRAINER: The independent professional providing the Courses. The Trainer acts as the principal provider of the tuition; City Vocal Coach acts as an agent to facilitate the booking.
• COURSES: The vocal coaching sessions or workshops facilitated by City Vocal Coach.
• VENUE: The third-party premises where Courses are provided.

3. FORMATION OF CONTRACT

3.1. Courses can be booked online via the Site. The contract for the facilitation of the Course is formed when City Vocal Coach sends a Booking Confirmation. 3.2. City Vocal Coach acts as an agent for the Trainer. By booking a Course, you are entering into a contract for tuition with the Trainer, facilitated by City Vocal Coach.

4. FEES & PAYMENT

4.1. Fees are payable immediately online at the time of ordering. 4.2. In the case of Fees paid by direct debit, the Client remains liable for the full Fee regardless of subsequent cancellation (subject to Clause 6). 4.3. Interest will be charged on outstanding balances at a rate of 4% above the Bank of England base rate.

5. CANCELLATION, TRANSFERS, AND REFUNDS

5.1. Consumer Right to Cancel: Under the Consumer Contracts Regulations, you have a statutory right to cancel within 14 days of purchase, provided the Course has not yet commenced. 5.2. Standard Courses: Full refund or credit if cancelled at least 72 hours before the start. Cancellations within 72 hours are non-refundable but may receive Course credit at our discretion. 5.3. Intensive Courses: Minimum 7 days’ notice required for a refund. 5.4. Missed Classes: Missed classes cannot be rescheduled. Course credit may be offered as a gesture of goodwill but is not guaranteed.

6. AGENCY STATUS & COURSE SERVICES

6.1. Agent Status: The Client acknowledges that City Vocal Coach acts as an agent on behalf of the Trainer. City Vocal Coach is responsible for the administration and facilitation of the booking, but the Trainer is responsible for the actual delivery and content of the Course. 6.2. Trainers: Trainers are independent contractors and are not employees of City Vocal Coach. The views expressed by Trainers are their own. 6.3. Venues: Venues are provided by third-party Venue Providers. City Vocal Coach disclaims all liability for the Venue, which is subject to the Venue Provider’s own terms. 6.4. Changes: City Vocal Coach reserves the right to change the Venue or the Trainer if necessary, providing notice as soon as reasonably possible. Such changes do not constitute a breach of contract.

7. INTELLECTUAL PROPERTY

7.1. City Vocal Coach grants the Client a non-exclusive license to use Online Course Materials for non-commercial, personal use only. 7.2. Clients may not store, reproduce, or commercially exploit any Course Materials without prior written consent.

8. LIABILITY LIMIT

8.1. Nothing in these terms excludes liability for death or personal injury caused by negligence or fraud. 8.2. Subject to 8.1, City Vocal Coach (acting as agent) shall not be liable for any indirect, consequential, or economic loss. 8.3. Total liability shall be limited to the amount paid for the Course or £100, whichever is greater.

9. NO PARTNERSHIP OR EMPLOYMENT

9.1. You agree that City Vocal Coach and the Client are independent contractors. Nothing in these terms creates a partnership, joint venture, or employer-employee relationship. City Vocal Coach acts strictly as a booking agent for the Trainer.

10. CCTV POLICY (Where Applicable)

10.1. Purpose: To ensure the safety of staff, students, and property at our primary training locations. 10.2. Retention: Footage is stored securely and typically retained for a maximum of 24 hours unless required for law enforcement. 10.3. Data Controller: The designated Data Controller for City Vocal Coach is Sam Marlow.

11. GOVERNING LAW

11.1. These Terms and Conditions shall be governed by and construed in accordance with English Law. The parties submit to the exclusive jurisdiction of the English courts.
